San Francisco rental analysis needs a unit-specific review of rent restrictions, tenant protections, reporting, and tenancy history. Building age, ownership label, or a seller’s statement does not settle every question. Check the current rules before serving notices, changing terms, or relying on future rent.
Are rent limits and eviction protections the same?
No. Limits on rent increases and protections governing termination are different legal questions. A claimed exemption from one does not establish an exemption from the other. State and local requirements can overlap, and required notices or other conditions may matter. Start with the Rent Board’s rental-law resources and the California Attorney General’s landlord-tenant overview.
Ask counsel to document the unit’s applicable coverage, the tenancy history supporting that conclusion, and any proposed action. This guide does not decide exemptions, permissible increases, notice periods, or grounds for a termination.
Can I use market rent in the pro forma?
Keep the existing lawful rent in the base case for an occupied unit. Show a future scenario separately, including the factual and legal steps needed to reach it. Do not assume a purchase, lease expiration, renovation, or change in ownership creates an automatic rent reset or right to vacant possession.
The NOI guide distinguishes actual income from projections. Review tenancy assumptions before spending time refining an investment return that depends on an unavailable use.
What reporting should an owner track?
Assign responsibility for the Housing Inventory, relevant Rent Board fees, current business contact details, and any required rent-increase license. The Housing Inventory FAQ explains the relationship between reporting and annual or banked increases. A license does not replace compliance with other increase rules.
Maintain a calendar and retain filing confirmations. Confirm the current requirements for the property, including exemptions and ownership changes. For a TIC, coordinate the building contact and shared responsibilities rather than assuming each flat is administratively independent.
What belongs in the deposit process?
Use current rules for maximum deposits, applicable exceptions, permitted deductions, photographs, accounting, refunds, and any local interest obligation. Do not use an older furnished-versus-unfurnished deposit formula without checking current law. DRE’s move-in guide and move-out guide explain state requirements; the Rent Board deposit resource addresses local information.
Keep the deposit ledger separate from a performance calculation. A refundable amount held for a tenant is not earned rent or a substitute for owner repair reserves.
What about repairs and short-term rentals?
Plan repairs around habitability duties, lawful entry, applicable permits, and tenant protections. An investment plan should not assume renovation permits authorize displacement. Use the renovation center for project organization and obtain property-specific advice on occupied work.
Short stays have a separate SF Planning program. Check the actual use, residency, eligibility, registration, loan, insurance, and private restrictions before counting booking income. A long-term rental permission does not establish short-term eligibility.
Use this guide to organize questions for the relevant property, legal, tax, lending, and insurance professionals. Actual requirements and financial outcomes depend on the property and the proposed plan.
